urgent help - Getting back on GC to US just before finishing 6months

Hi,

I am getting back to the US just a week before I complete 6 months. The last time I was in November 2010, I was questioned at the POE as to the reason of my absence with details. My concern is that at POE do the officers check the multiple trips made on GC and track and ask questions. I had to be out for long gaps since a year for personal reasons but should be staying back on work now.

Are there been any cases about GC being taken back at POE on these grounds. Any help will be appreciated.

Yes to both questions. You should have gotten a reentry permit.

But if they take away your green card at the POE, you'll get the chance to plead your case in front of an immigration judge who will make the final decision whether to revoke the GC or let you continue to have it. The POE officer can't revoke the GC.

I got a follow-up question please.

- As long as we receive a electronic confirmation from Fedex or UPS that the I-131 package has been delivered to USCIS offices, we should be fine to leave the country right? (and fulfill the requirement to be in US when we file the application). Or, do we have to wait for some other kind of confirmation from USCIS that YES, they have opened the package and are working on my case ( I hope not)...

So... I can drive in to US (from Canada), swing by to the local Fedex/USPS office, drop my application (with Tracking facility), stay for a day or 2 and come back to Canada.

I then go back in when I have the appointment. There shouldn't be any issues with this right???

I guess not. You're lucky you're in Canada. Your biometrics notice will come to your US address, so you'll have to go there or have someone check your mail and send it to you.
 
Yup. That's what the plan is. The mail (biometrics date) will be sent to relative's address and we will be flying in to visit them in the month of July.

I am just trying to time it right that so that we get the biometrics appointment while we are there (in Baltimore, Maryland). I plan to drive to Montana in June (4 weeks prior) to drop off the letter.

Should work right???
 
Yes it should, though when you receive the biometrics appointment notice, the date will be in the future, so you can either wait for your relative to open the envelope and tell you the date before you book your flight, or you can try to do an early fingerprint walk-in and explain you won't be in town for your date.
 
Actually we have the tickets on hand (5th of July) and that's why I am trying to time it right. I am planning to drop off the application around 6th of June.

I got a 1 way ticket and was planning to get the return after getting the receiving the appointment notice.

Is the early walk-in for biometrics a possibility in every USCIS location? I didn't know I had this option. I will going to the Baltimore, MD office.
