It should be OK. Degree in Electronics and Degree CS are taken equally. more then 60% of the subjects are same. Even you can get educational evaluation also without any issues.
FYI I have same degree and had same requirement of Labor.

Did you use substitute labor?

Nowadays substitute labor gets more scrunity than an original. When his attorney talked about "risk", I think he was refererring to this issue.

Yes it is for a substitute labor

However the lawyers concern is basically for Educational Equivalence
since NSC is very strict about such things

Thanks

Then go ahead, do not wait.
Whether it is an Educational Equivalence or USCIS strict scrutiny, you have to take a chance or risk. Let see how USCIS sees it.

when you say same

meaning was it written bachelors in computer science, engineering or math

as per the lawyer the engineering in the above line can be confined only to computer engineering.

Get a course by course evaluation. It should be straight to show that you have done required credit as EE and CS are closely related. Get evaluation done from atleast two reputed agencies. DOL/INS doesn't publish degree equivalance - they have to go by the evaluation agencies.

One of the agencies which is good is trustforte - they have very good reputation.

I will give you an example: Robotics is not offered as major in most of the Indian Universities(or say Textile). In case of robotics, one needs to show that degree covered all the course credits as per US standards. Someone who did a good number of course in Applied Mech/Mech, EE and CS should be able to do that. Do you think it is tough? Depends - most of the Indian colleges make you study Electrical/Electronics/Mechanics in one way or other in first two years(even as phy/maths). You should be able to do that.

For second example:

Chemical Engineers do many courses which Textile Engineers do - course by course evaluation will surely help the case. Is that as close as Robotics/EE/CS? Perhaps no. But is the chances less? Again no - it will depend on evaluation agency's evaluation! A clean Chemical/Textile can beat a lousy Robotics/CS/EE case.

Another pointer:

Try to show More than Required Credits for intended course. A line specifying same MUST be mentioned on education evaluation.

My three pointers to you are in bold.

All the best.

From your PM:

....
....
line 14 says bachelors in
computer science,engineering or math

I have 4 yr bachelors in electronics.

Who can surely tell me the probability of
such cases going through? What is your opinion?

Assume everything else is proper.

Got your PM and saw your post too - since I saw post before pm - so just decided to post here.

You need to show equivalence as the above discussed case.

For chances - you have very good chance - you should be thru. Just one thing read my previous post and take educational evaluation issue seriously. If your lawyer is not getting the point, check another lawyer or make him find with evaluation agencies.

Go For It

I used Sub-Lab original labor with EB2 MS//
I got my 140 approved ( I applied for 140 first and then for 485.. 485 pending because of retrogression) recently with BS (Elect) + 8 Years Exp (all in IT field). Also I am using Sub-Lab with my current employer (nothing like future employment case which is more strictly reviewed). I got approval last week so I guess it may have went through new procedures.

Good Luck.

more info

Is there a sure shot way of knowing how the ; in the comp sci;engineering
or math can be interpreted as?

Any info from INS on how to interpret the information mentioned in the
ETA form 750

i know this is a silly question but knowing NSC you should be very
careful of educational equivalence
