Urgent Help - changing jobs AC21 rule

Hi Experts, i really need some help, i have voluntarily resigned from compnay A, fearing that i might lose my job shortly(the company was going towards globalization), the company in these efforts offered a voluntary separation package which i accepted. My GC was filed under the title of "Software Engineer".

Now i have moved to a different state where salaries are higher than where i came from trying to find a job. I got a job offer from company B (over 35k hike from the salary i was at when my labor was filed with company A in 2000), where my new title would now be "Architect (level 3)". I will be working on the similar technologies that i used to work in company A though this is a senior level position comparitively, i want to know if this will cause any problems, this job offer with company B is a full-time offer and i really want to join this company.

When i left company A, my attorneys informed INS that they are no longer representing me (ofcourse they did not inform INS that i left the job intentionally nor did they give any info that would jeopardize my case). My attorneys have also informed INS that they should contact me directly in the future. I have not appointed any attorney so far because i am not sure that anything needs to be done. My FP's should have expired (it has been more than 15 months), but my case is not moving. My priority date is Jan 3, 2002 (i filed at california INS center). I want some advise whether i can accept this offer, if i get an RFE will it be good enough to draft a letter working with my manager in a manner that shows that the duties are similar to my previous job duties? Do i really need to appoint an attorney? (the are charging around 1500 bucks). Please adivse ASAP. Thanks

----- Your past job title was software engineer on LC better keep the same job title, skills when you send the new job offer letter to BCIS. Better to have the copy of approved LC from past employer, it will help your new lawyer to draft the future job offer letter. You have not provided info if your I-140 is approved, when it was filed, when I-485 was filed. You should check BCIS August Memo for AC21 it has been posted in many threads

Yes my I140 has been approved long back. In regards to keeping the similar title, the deal is that the new company apparently does not have this title, they are structured a bit differently.

Same title is a nice to have but for technical positions that is not easy to achieve. That is why the AC21 clause mentions "same or similar job" - just make sure the new job description is similar enough to the one in the LC so that even a layperson is convinced
