URGENT HELP - Can I add my wife to my greencard process -- PriorityDate Retrogression

Here is my case. I got married recently and want to add my wife to my greencard process. She is here with her H4 visa. I got my EAD (I'm not using it yet). My fingerprint is going to be on Oct 11th (I have delayed my previous fingerprints once that was on Sep 16th).

The restrogression priority date is going to get effective from Oct 1st. And my attorney said they cann't file the 485 for my wife within Sep 30, becauce they said the visa numbers are not available ( http://www.travel.state.gov/visa/fr...letin_2616.html ). Is there anyway I can file my wife's 485 within Sep 30th ? My priority date is 09/14/1999 and my category is EB3.

This is URGENT. Please help. I appreciate all your help on this.

If you are from India, China or Phillipines, your Attorney is right. No, you cannot apply her 485 as EB3 is set to unavailable until Sep 30 2005 for India, China and Phillipines and from OCT 01 2005 the cut-off date is set to Jan 98. So you have to wait until the cut-off date reaches your PD.
