Urgent help about AP...

Hello ,

Our 485 is pending over 6 months ..We have AP , EAD[never used] , FP done.

My family needs to go India due to some urgency..Can they use AP to travel and come back ..They don\'t have valid H4 visa stamped ... I have never used EAD ..working on H1 ..

My friend told me that they can use AP only if I am using EAD otherwise they need H4 visa stamped ...

Your friend is wrong

Your family is free to use AP. No need for H4 visa stamp (although you have this option too).

Use AP without a hitch

Well I myself used to be on H1. I change status from B1 to H1 and did not have any H1 stamping. When I got the AP , I went to India with my wife and son without any problem. Only thing when you come back is you will have to go thru secondory INS, in which they will ask you few simple questions to establish your Identity. I was also worried about travelling till last moment but it was fun.
