This is the sequence of events that happened with my wife's H4 . She initially came to US in May 04 on H4 Visa , I moved from company A to comapny B in October 2005 . At that time both of us got our extension till May 4th 2007.
Last year we applied for H1 on MAy 26th 2006 , in June of that year we travlled to India ( without realising that we had abandoned our COS request ). Got stamped in Delhi and came back in July 06.
We thought she was on H1 starting 10/01/2006. As she was pregnanty and due in Feb 07 we did not apply for SSN , My WIfe applied for SSN in March 07 and did not hear anyhting back from them .
In May I extended my H1 status without extending my wife's H4 .
On 05/18/2007 - I got a Call from the DHS asking to interview my wife in person for 45 Minutes - I immediately called my Immigration attorney and explained the sequence of events and she told me that my Wife was out of status as she had abondanded her H1 COS. She suggested that we file her H4 extension promptyl . I maile dit out 05/19 under premium processing .
Has anyone had a similar expereince like this ? Any idea as to what the DHS officer might ask ? Did the application for SSN trigger this whole problem ?
Any insights from you guys would be very helpful. She did not work for her H1 employer at all.
Please help , the interview is next tuesday .
