URGENT!!!H4 Query...Please respond(Jaxen/Jim)

Recently my wife applied for H4 visa at Chennai consulate and the cosulate sent a query asking for the following documents:

1) Original I-129 petition for Nonimmigrant Worker
2) Labor Condition Application (LCA)

I requsted these two documents from my employer but unfortunately my employer has misplaced those documents.

Can anyone please advice what to do in this situation and what would be the alternative solution?

Any help or adivice is highly appreciated.

Check with your lawyer to see if he has any copies. I am surprised that your employer has "misplaced" documents.
Check with him again for any copies. Also I have not heard of consulates asking for copies of petiiton, only original approval notices.

It is always a good idea to ask and get copies of ALL DOCUMENTS filed related to your immigration process. Hindsight is always 20/20!

The employer is REQUIRED to maintain a copy of the LCA in the Public Access File. It's a good idea to check with the attorney for a copy. If all else fails it's possible to do a Freedom of Information Act request with INS but that will take MONTHS.

Thanks for your reply.

I'll check with my attorney first.Even if attorney has a copy that would not be a ORIGINAL document.Original document will be submitted to the INS at the time filing the petition.So how can I provide ORIGINAL I-129 petition to the Chennai Consulate?
