URGENT: H1b visa revoked without informing and H4 visa expired

Hi, I am an Indian citizen and need advice on how to proceed from here.

I last entered US in 2008 Feb on H4 depended visa(based on my husband's H1B visa), with validity of I94 until 01-Oct-2009. I applied for H1b visa through a consulting company in Apr-2008 and was informed by employer about the approval in Feb-2009. i applied for and received my SSN in Feb-2009. My employer dint have any work for me, nor did he pay me anything until now. He just informed me yesterday that my H1b visa had been revoked in Sep-2009, and this is the first time I am hearing of it.

Meanwhile my previous H4 stamping\I94 got expired in Oct-2009 and I dint get it extended since I thought I was still on H1.

Now the situation is that I am neither on H1 nor H4 status. How do I proceed from here?

Why were you not reporting for work? You have to be paid at all times while on H1B so if you were properly working, you should have been aware of your situation.

However, what is the date on your l-94 for your H1B - assuming it was applied as COS and not consular processing (otherwise you should have appeared for stamping and entry on either the H1B or H4)? If it is not expired, exit and reenter on H4 before you are illegally present. If your H4 I 94 has been expired less than 180 days, your illegal presence has not yet triggered a ban of 3 years so exit and reenter immediately to regain your H4 status and legal presence.

If all of your I-94s are expired more than 180 days, you are out of luck and need to exit the US immediately as you may be picked up, detained and deported.

My H1B I94 is valid until 09/26/2011, while my previous H4 I94 is expired since 11-Oct-2009.

My question is this - which I94 will they use to determine status. I think its the H1B I94 since thats the newest issue one. But since the h1-b was revoked as of 08-Oct-2009(which we just came to know 2 days back), is the H1 I94 invalidated at the point of revoke?

-----Your H1 Petition has been Revoked by employer Sep-2009 and you are not on H1 status. your H1 I-94 is of no use as you are not on H1 status and also not on H4 status. Go out of US ASAP.
