I am a USA citizen and am running a small gift business in USA for last 5 years with annual revenues varying in range of 250-400K in last 5 years. I need to hire a web programmer from India to come and take over some crucial web related work that we see ourselves doing on a long term. We have already identified the person in India. Here are my specific questions and would appreciate if somebody can help us here:

1] We have never done any H-1B visa's before, can our size prohibit us from doing a H-1B visa?

2] What are the costs involved in doing a H-1B visa?

3] What is the fastest way for us to do the H-1B visa?

4]Are their any other things that need to be taken care of after the H-1B visa is approved from our side in terms of paperwork with the government?

5] Can anybody refer a good lawyer we can use who can do it cost effectively for us?

I will appreciate your earliest response.

Thanks

Tom

1] We have never done any H-1B visa's before, can our size prohibit us from doing a H-1B visa?
No, your size is ok as long as you can prove the ability to pay your emolyee.

2] What are the costs involved in doing a H-1B visa?
Anywhere from $2000.00 to $3500.00 depends if you go for normal processing or premium processing and how much your lawyer charges.

3] What is the fastest way for us to do the H-1B visa?
Premium processing which costs extra $1000.00 than normal processing.

4]Are their any other things that need to be taken care of after the H-1B visa is approved from our side in terms of paperwork with the government?
Your lawyer might guide you better on this.

5] Can anybody refer a good lawyer we can use who can do it cost effectively for us?
Depends where in US are you? There are plenty of good immigration lawyers.

I agree with the first three answers but there needs to be a bit of clarification on the last two.

4]Are their any other things that need to be taken care of after the H-1B visa is approved from our side in terms of paperwork with the government?

Yes, you need to set up what is called a "public access file". For some companies (those that have been judged as "willful violators" and companys that are "H-1 dependant"). For you, this will probably nothing more than a copy of the LCA and a couple of statements.

5] Can anybody refer a good lawyer we can use who can do it cost effectively for us?

Location does not matter that much since things can be emailed, faxed, and overnight mailed.

one more clarification

Dear Jim and Khush, Thanks for your response.
I and my wife are only two employees on the company payroll. I want to ensure that there will be no complication in visa approval, we can surely justify and prove that we will be able to pay the minimum prevailing wages. Please advise if this looks fine?

Regards

Tom
