Urgent :H1B pending 7 months

Hi, i am a 2nd year resident at Hahnamann University hospital, i had come to india in dec 2004 to have my H1B visa restamped as my university gave me a 1 yr petition.
I had my visa interview on the 3rd of Jan , and due to misplacemet i did not have my old EXPIRED passport which had 2 EXPIRED B1 visas , so in reference to section 221(g) , INCOMPLETE DOCUMENTS, i had my visa rejected on that date, howeve i was told that the embassy would contact me after they reassess my case and would contact me in 3 to 4 weeks, however after 4 weeks i was informed that my visa processing is pending and may take upto 6 months.
Its now about 7 months and i still am told that my application is pending , i dont know what to do, so fas my program has kept my place but they may not wait much longer.

1. how long does it usually take for these kind of delays .
2. is is possible that they do not give me a visa.. I HAVE ALL THE DOCUMENTS WITH ME NOW, including the old passport.

3 is my delay anything to do with me H1b capping for 2005.

4 can legal help be of anyuse.
 
where you had your h1b interview?which consulate?

well am also victim of 221(g) and waiting for any kind of reply since 28th sept 2004 almost 11 mnths now.

Do one thing, register post photocopy of your old passport and those missing documents to your consilate, this might help. I know few people who got visa after submitting missing documents.

I don't think any lawyer or attonery can help you incase of 221(g), only thing you can do is wait and keep contacting consulate....but you can always consult immigration expert.
