Hello:

A month back, my company filed for and succesfully got me a H1B visa, set to start from Dec. 1, 2003.
Subsequently, I got laid off on Nov.10, 2003, even before my H1B comes into effect.

However, my OPT (Optional practical training) from my F1 visa ends on Dec. 15, 2003.

I have the following questions:

1. Since a H1B was issued to me, does my OPT status stand nullified?

2. Till when can I legally remain in the US, in the grace period...since I currently do not have any employer?

3. Given these circumstances, what is the latest that a new H1B under another employer be filed by? Also, is it enough to just FILE a new H1B before this date, even if the approval only comes in later?

4. On a slightly different note, my F1 visa is valid till July 2005, but mentions a particular University. If I get a new I-20 from a different University, do I need to get a F1 visa re-stamping done if I have to re-enter the country on the new I-20?

Thanks a lot..

1. No, OPT is still valid
2. Used to be 90 days from OPT expiry
3. New H1 is fine, but if OPT expires and H1 approval has not been accorded, you cannot get paid by the employer
4. Question for F1 forum.
