Please help !!
6th year H1b expiring: 1/23/09
PERM priority date: 1/1/2008 (2 RFE's and still pending)
7th year extension filed: Oct 2008 (just found out that RFE was responded in Jan 2009 - still pending)
Im really worried that about these RFE's.
1. Say in February 2009, either my H1b application or PERM gets rejected. Would I be considered out of status from 1/23 going forward? Because I know I can work beyond 1/23 with my H1b petition pending.
2. Lets assume that H1b gets approved and then PERM gets rejected in say, March 2009. What would that do to the approved H1b petition as the petition was approved based on the pending PERM app? Would I be considered out of status from 1/23 going forward? Or out of status from the PERM rejection date?
3. What if the PERM gets rejected in before H1b is approved. What would be my options at that time?
Other questions:
a. Would switching the H1b application to Premium Processing help?
b. I have a EAD card based on my wife's LC application. If I were to switch to that for my employer, can I switch back to H1b when its approved? Is this advisable?
I would really appreciate some responses on my issue as I have minimal time.
