Urgent. H1 129 petition reopned and being reviewed.

My priority date is Oct 2002 and I got my labor approved in Jan 2005. I could file my I485 in June 07.(EB3 retrogressed) My 140 was applied and approved in 2005.

in 2006 my H1 was extended for 3 years valid till oct, 2009.

I got a mail from USCIS regarding this H1 that was approved in 2006 with following message.

We reopened this I129 petition for a Nonimmigrant worker and are now revviewing our earlier decision. ....
Our review should be completed in 30 days. We will notify you by mail when we make decision or if we need something from you.

My attorney has not received any mail from USCIS. They will call USCIS in a day or two for details.

I have left this sponsoring employer in Jan 2009 using EAD and working fulltime for a fortune 100 employer. AC21 not yet filed.

Please let me know if anybody has any clue/suggestions etc.

I am getting little nervous about this one.

----------------why not to file AC21? if the USCIS send RFE then at this time they are asking lot of documents and if USCIS send NOID then more money to lawyer for replying.

******************* File the request to invoke AC21 (keep the copy of documents that you send it to USCIS)

******************Others will post. at this time USCIS is asking lot of documents for H1 extension or H1 transfer. USCIS also sending RFE for lot of documents for H1 extensions and H1 transfer.

Do you think that my previous employer may have revoked the H1? I am more than inclined to think it may be the case.

also do think that if previously approved H1 in due course, gets rejected and that makes my stay from 2006 to the time till I filed my 485 (i.e june 07) becomes illegal stay.. ? Please dont think I am overreacting.. I just have kind of got worries....

-----------------------------you need to talk to your lawyer. if you had valid status when you filed I-485 then I dont see problems.
