Hi guys,

Today my sister attended for the visa interview at chennai consulate. Her qualification is Bachelor of commerce and PG Diploma in Computer Applications. She has Got 6 years of experience in Oracle Applications in India.Visa officer took her original H-1 papers and said that he is sending her papers to home land security and stamped in her passport as Application Received. What could be the problem? We did not had any problems with her qualifications at the time of H-1 approval. We have got her education evaluation with a lawyer when we have applied for her H-1 to INS.

Any help in this matter is appreciated.

Thanks,

It simply means that consulate officer thinks that she is not qualified for H1 and wrote the same to USCIS to revoke the petition. Officer may have asked her few technical questions and she may be unable to answer. for more info talk to your lawyer

Thanks for your reply!!Consulate officer did not ask her any technical questions. She is actually very much experienced technically. But looking her Bachelors degree in commerce he took the H-1 original papers and said Home land security will investigate the case. She got PG Diploma In Computers and management from a University.Lawyer did her Qualifications evaluated when he filed her papers for H-1 to INS and they got approved with out a query.

Consulate officer faxed a letter to the company in U.S saying that they will investigate the case and send my sister a letter with their decision.

Did any one heard of similar kind of case earlier?

Any input is appreciated!

I don’t know what actually happened. The other reason officer may be suspecting that her degree/diploma may be fake. The reason behind is that in past from Chennai side many came to US on H1 with fake degree certificate and fake Exp letters. Chennai consulate also has fraud detection unit. Better talk to the lawyer/employer who filed her H1 and lawyer may be of some help
