Here is the situation

I just got my H1 transfered from Company A to B. I was working for this company B, 2 years back. I have a stamp on my passport from Company B which expires on 15th Jan, 2002. Last year I joined that Company A and transfer my visa from B to A. I again joined company B so I got my transfer done from A to B. It just got approved. Now, while working for company A, my wife came here in USA, so she has H4 stamp from company A, which is valid upto 2003. I\'m planning to go to India and I will be getting my new visa (From Company B) stamped there . My questions is

1) Do i have to get my Wife\'s passport stamped with new visa of Company B
OR she can travel with her old visa and my new I-797. If she can, would it create any problem while coming back in USA as they will see different visa stamp on my and my wife\'s passport.
2) When I send my passport for stamping in drop box at India, do I have to send my I-797 of company A ? What other papers they would need besides my new I-797 from Company B.

I\'m leaving for India in a week. your help is greatly appreciated.

1. Do your wife\'s H4 stamping too. You are under legal obligation to do it.
2. Can attach a copy of old 797 to prove your continuance of status. Explain this clearly in a letter.
3. Recent paystubs, letter from current employer (for both you and your spouse), LCA copy,...

WRONG:You do NOT have to Stamp/change your wife H4 Visa even if you have changed company, She is NOT working for a company H4 is derivative visa it has nothing to do with your company it is related to you being her husband.
SEE: http://travel.state.gov/revals.html

Please note that you do not require a new visa merely because you have changed employers and received a new I-797 petition from the Immigration and Naturalization Service (INS). If your current visa is still valid, you may reenter the US with that visa as long as you are in possession of a valid I-797, even though the visa contains the information from your former employer.

But if you wish you can stamp your Hib in India but your Wife does not need it as she has Valid visa till 2003.
Please Correct me if I am wrong.

getting h1 visa stamped on passport

hi, since they require the h1 work permit holders to travel to a US consulate outside US for
getting the passport stamped (for re-entry to US after travelling abroad), can we still go to
a US consulate in Canada/Mexico for this?

Thanks!
