Hi ALL:


I got laid off July 30th and got an RFE issued on Aug13 for
Employment Letter
Three pay Stubs
Past three years of Tax forms

I started on a new job on Sep 4 and have been working ever since by God's grace. I am submitting thefollowing to INS

Employment Letter(Exactly same as original from the new employer and with a higher salary)
Two Pay stubs(Since the pay stubs have two week lag. Third paystub is due Nov 1st but will not make the deadline for RFE i.e.e Nov5)
All the three tax forms.

Now my questions are:

1) What are the probabilities of approval?
2) Does it make a difference since I changed the employers due to a layoff?
3) How big a difference does it make in terms of two paystubs and not three?
4) Is my type of case pretty common as my EAD is expiring on Feb 28?

Since you changed job only after 180 days and that too because you got laid off by your GC sponsoring company I think your case is perfectly eligible for AC21 rule in this regarding. As far as I can thinkof there should not be any problem getting your approval based on what you wrote.

How ever regarding paystubs I think you should also attach last pay stub from your old employer to make it three (note that RFE is about your "3 recent most" paystubs). In my view it is something like put all your pay stubs in order and picking 3 recent most...

you should be fine

you are eligible for AC21.
Even if you get the third pay stub on Nov1st and send it to INS, you should be fine, because i think INS goes w/ post mark date. But check w/ your lawyer. Hope your case gets approved soon!

I think you should be ok, and attach the pay stub from your old company too.

My case was worse than you (laid off two weeks after 485 filing) , RFE, and still got the approval. Maybe I am lucky. :)

Just a little strange that INS only gives you less than a month to respond to the RFE. Mine was given 84 days.

Thanks everyone for the replies.

I have talked to my employer and he has agreed to fax me the pay stub on 30th so that I can fax it over to the lawyer the same day and may be they can mail it over to INS the same day too.

Do you think that u can mail the the last paystub separately from the documents that my lawyer is planning to send on the 28th October?


I hope I have the luck to get it approved. Just any comments on my center being San Jose. I moved to Fremont California.

Do you guys think that I should change my address or leave it as it is 'coz if I change the address there will be transfer of case and then the case can be delayed further as well? I do not know what to do. I am confused.
