URGENT GURU's - H4 Visa denied at chennai

Guys,

Urgent response need from the GURU's

One of my friends got married in India and sent his wife for H4 visa stamping. The official asked for W2 form for yr 2002.

The problem is he did not work for the whole of yr 2002 and the emp did not pay him.

He filed his 2003 taxes and submitted his 2003 W2 with him when his wife went for stamping.


So whats the best thing to respond to this query!!

You say that he did not work for the whole year 2002 and employer did not pay him. What does this mean? He was an employee (on bench) for the entire year and did not get paid? When exactly did his employment begin?
If his employer has violated the terms of H1 ( paying a salary that is at least what is in LCA and no benching) then consulates have been refusing visas in such cases. They haven been verifying that H1 employees are being paid as per LCA requirements.
