My husband's 6 year term on H-1B expired in Jan'06. We received the 7th year extension approval notice for both of us (I'm on H4) in Nov'05.

On the approval notice that we've received, my husband's approval notice has "I-797 C Notice of Action" printed at the top right-hand corner. and just above the I-94 attached to the lower bottom portion of the document, "Form I-797 A" has been printed. On my document, there's only a "Notice of Action" printed on top and "Form I-797A" printed at the footnote.

We are all set to go for our visa stamping at Vancouver in March. However, when we saw the requirements for visa stamping at Vancouver, they've mentioned that "Applicants should bring original notice form I-797 (A or B)(I-797 C is not acceptable)".

Ours is also approval notice, but it is on Form I-797C.

We are really confused about this.

Anyone from this forum , who got their 7th year extension approval notice, on Form I-797C? or ours has been printed by mistake on Form I-797C????

Please respond ASAP!!!

~S

797C is courtesy copy, not original.
Read 797C, and there should be saying
"Original is sent to: <lawyer's or employer's name>".

Check your lawyer and employer.

GotPR is right, 797C is not original. My bf received both 797 and 797C (not sure if it is by mistake) and only use the 797 for visa stamp and entry.

Thanks GotPR and yoyo_gotmom....that was truly an eye-opener....we'll now have to cancel our vissa stamping appointment at vancouver, coz the VO wud definitely not accept an I-797C (courtesy notice).

The problem, is that our hubby's co's immigration attorney has been refusing to communicate with us, saying that the one we have right now is a valid approval notice, and he doesn't have ne ther notice that was sent to him by INS.

We also have to visit India in May for family reasons, and looks like we'll be stuck here because of some goof-up by the attorney/INS.

What action can we take now, so that we receive the original I-797 from INS ASAP???....please advise...

Thanks,
~S.

If lawyer said so, you should talk to HR at your company. Obviously, CC is not accepted by consulate and you definitely need original(Show them the website saying 797C is not acceptable for visa stamp).
You can file for duplicated copy of I797, but it takes a year or so to get it, and I do not think it works in your schedule.

I-797C has new I-94 attached to bottom portion...

Hi GotPR?,
My husband had posted a detailed e-mail to the immigration attorney and cc'd it to HR dept of his office today. He received the same one-liner adamant reply from the attorney saying that the approval notice that we have is not a courtesy copy, but a valid approval notice and he's insisting that we can use it for visa stamping.

One thing that I wanted to clarify from you...Our approval notice i.e I-797C has the new I-94s attached to the bottom portion. Does a courtesy copy usually have new I-94 attcahed to it?

Please clarify....

Thanks in advance,
S
