URGENT!! Do I need PCC for this stay???

After my labor approval, I have just filed my I140 with CP option.

I am little bit scared now, since I worked for around 10 months i Malaysia. I don't know whether I need to submit PCC for that stay or not. If so what are the options for me to get PCC for that stay, how can I get that. I don't know any one ther eby now.

This was what bugging my mind since I filed I-140 with CP and making me feel that I made a wrong decision for going throuhg CP just coz of this.

Guys please help me for peace of my mind. I know there are lot of knowledgable person like KD here, who would surely respond me.

You need a PCC from foreign country only if you stayed in that country for more than 12 months.

Since you stayed for only 10 months, I guess you do not need any PCC from that particular country.

Email the consulate where you intend to attend CP about this and if they say you do not need, then print out that email for your records and save that email in a safe place .Take the print out when you go for CP.

However, it might be good if you have a PCC from there incase you do not get any reply from the Consulate.

I concur with gcchahiye on the point that only if you stayed for more than 12 months in a foreign country you would need a PCC of that country but still go ahead an send an email to the consulate where your CP would be processed.

Again since your I-140 is recently filed. I would wait until I-140 is approved if you have to ultimately have to get PCC from that country since certain PCC's are valid for 6 months while others are valid for 12 months...so to play safe apply for it once your I-140 is approved!

Though it mentions that those who have resided for a period of one year or more may apply for the certificate of good conduct, there is no harm in your trying to contact them to find out if they will issue you one too.

Thanks for the advice. this was my first post on this CP thread and within a day I got 3 responses. I am surprised and thank you again.

One more question. I am going to New Delhi for my CP interview after my I140 approval. Could I ask them now whether I need PCC for Malaysia stay now, if so where can I get contact information for the New Delhi consulate?

Malaysian PCC

Hello my friends,

IF you do need to get a PCC from Malaysia, I STRONGLY suggest you do it WAY before hand as Malaysian authorithy is notorious for lonnnnggggggg processing time. Atleast this was my experience and a couple of others whom had to do it a year ago.

Processing time takes anywhere from 6 to 12 weeks.

Thank you very much for this important information. I stayed for approx. 10 months there, so I need PCC in that case for my CP case?

Please let me know if they issue PCC for that much long stay. I checked the website and they are saying stay should be more that 12 months. Please give me advice on this.

Like the other on this thread have said. If you only stayed 10 months, you don't really need PCC from Malaysia. Only needed when 12 months or more.

BUT I would send an email to NVC to confirm it at least if the consular officer tries to be funny, you can pull the email out.
However, I think you should be fine withour MALAYSIAN PCC.

Just a small add to tungfong's comments...send an email to the consulate where you will be going for your cp interview asking them if you need a pcc? And once you receive a response, carry print out of that email!

I think since you are going to an indian consulate read this:

It explicitly states that if you stayed for 6 months or more after the age of 16 in a foreign country you need to get pcc of that country!
