Hi I485/AC21 gurus,
This is my first post on this board. I have been a visitor for a long
time though.
I have filed my I485 in May 2002. I have been with the same
employer - Consulting firm - since I came to US in Sep 1997.
I just came out of a long-term project. Suddenly the market
seems to have dried up for contract assignments. I have found
a short-tem (with possible extentions, but dont bet on that) project.
But the problem is that the new firm will take me as a 'Contract
Employee' only for the duration of the project.
I am wondering what my options are.
An optimistic estimate will take 6 months for a decision on my I485.
Is one allowed to take a 'contract employee' position under
AC21?
let me assume it is allowed. Then, if the project / assignment is
not extended till a decision is made on my I485, am I going to
be in any big-time trouble?
During all this, what if I get RFEs? Does using AC21 require any
documentary support from the new employer?
If my current employer is willing to take me back in the future, will that help me in dealing with AC21 and/or RFE related issues
down the line?
I know I am asking a lot, any help is appreciated
Thanks and regards,
S Vengat
