urgent! change of DOB in passport!

My wife has wrong DOB in both passport and in her Birth certificate (her school certificate has correct DOB). WE have to fix both of them. She is in india right now. I believe we need a court order to fix them both. Any idea how long does it take to get the court order? To People who have done that before: Can you give some tips?

Once you file in the court, can you use that along with affidavits from parents and school certificates to file for H4? Will that be a problem? Though, it may be possible to get H4 by just writing down the same DOB that is in passport in her visa application, since i am expecting a CP interview in october, I dont want to screw that up. SO, let me know if it is possible to get H4 in the mean time while we wait for court order.

I even had wrong birthdate in my passport. First of all you need to obtain correct birth certicate. Do whatever necessary required for birth certificate. After that you need to file suit in court, they will issue orders to Passport office. In my case I was in USA, so court also issued order for Indian Consulate, Chicago. The whole process took about 2 months. That was 4 years ago.

If she has wrong but same DOB in her passport AND (useable)birth certificate, you need not bother to change anything provided you have been using that DOB in all documentation like H1, I-140, driver license, SS number application, etc. At your CP interview they only check birth certificate against passport and the application. A useable birth certificate should include full name and both parents names. Since the DOB matches in passport and BC, there should be no problem.
If not, then you will have to go thru the painful process to get a new birth certificate AND to get the passport changed.
 
actually the passport has the year wrong and BC has the day wrong. so, most probably, i need to get a court order
