Urgent, can my Dad file I-485?

Hi, all. my mom and I took figer print on 11/08/01. My Dad came over USA to visit us as H-4 on 11/09/01. I just read some previous posts here. It seems my Mom still can file i-485 for my Dad now. Is that right? should we ask our lawyer again?

it\'s really urgent because it seems that\'s the only way to keep my family being together.

Is this employment based if so he can apply it any time before the primary applicant is approved.

yes.my mom\'s application is employment based.

but my dad is on h-4. he doesn\'t do any job here. how much are you sure he can apply.

is that possible he get declined after he files?

If your mom\'s GC is employment based, then she can file for I-485 for your dad. Better do it ASAP as she cannot do it immediately once her GC gets approved.
