Urgent - Am I eligible to file for 3 year extension for H1?

Dear all,

I am a Brazilian national. My H1 is expiring in couple of weeks (6 years are finishing). My company had filed for my GC through PERM in Feb/07. My I-140 and 485 was filed concurrently in April and I received my I-140 approval in the beginning of May. 485, EAD and Advance parole is still pending.

Am I eligible to file for an extension of H1b for 3 years at this point in time or not? One attorney has told me that I am eligible and the other says I'm not. I'm very confused. If anybody knows the law, please let me know.

You need to know which EB category you are in to see if you can get 3 years as of today, but certainly you can not get H1 extension after July 1.
