Hi,

My I-485 was applied in January at Vermont. I got my EAD and the finger priniting is not yet done.Currently on a L1 visa till Dec 2003
Due to unavoidable circumstances , I need to travel to India for a long duration(more than an year)

What are the options of continuing the GC process ?
Is it possible to withdraw the I-485 or put it on hold till i come back?

Please advice

As long as the job offered is available, you can be out of US for any length of time while 485 is being processed.

Thanks for the info nkm.

Shall i wait for the finger printing to be done or if i get a finger print notice after i leave, can i postpone it and for how long?

sriramb_2003:

“Currently on a L1 visa till Dec 2003”

----- Once I-485 is filed you need valid visa stamp in passport to come back to US or you should get AP before leaving to India and enter before AP expiry date, if you don’t enter before AP expiry date your I-485 will be abandoned. Speak to your lawyer for your options
------ Get your fingerprinting done, you can only postpone fingerprints once or twice and they will send second notice, if you again postpone 3rd time and if you don’t go for fingerprints next time BCIS has the authority to cancel the I-485 as your case will look suspicious and they will think why you don’t fingerprinted?
