Urgent: advice needed, friend in immigration jail

Hello everyone,

I know that this forum may have some brilliant advice for this case. My friend's boyfriend was taken to the immigration jail this morning and she is in despair trying to find an attorney to get him out.
This guy applied for asylum, got rejection at the interview and another denial in the immigration court. The court ordered a deportation, but his lawyer applied for appeal. The appeal was being reviewed and the INS sent some very important paper to the wrong address, so that this guy never received this paper and did not reply. Due to it, it appears that his case was closed and today they came and took him away. The attorney that was dealing with his case is on vacation abroad and other lawyers that she contacted were not very comfortable with such types of cases. She does not know all the details of the case as her boyfriend was working on it with his lawyer. All of the info she has is described above.
Has anyone been in a similar situation? What is the best thing to do? Is bail possible? How much time do they have? Or he is going to be deported immediately?
Any advice would be appreciated.
 
How long is he in USA ? In wich court is his case , and in what state ?

He is in Philadelphia, PA, but I do not know which court. This guy has been in US for 15 years. I think they can pay expensive lawyer right now - it is a desperate situation anyway. Please PM me the name of the lawyer. Thank you.
 
I can understand why it would be difficult to get an attorney to take on the case, given that the GIRLFRIEND does not know the circumstances. They are trading on thin waters, because should they give inaccurate information, that contradicts his asylum application, that could open up a new can of worms.

I guess you are doing the only thing possible, however what status has this guy been on for 15 years? and what circumstances was his case denied, not once but twice?

How come Immigration sent the letter to the wrong address? How did he find out? Had he changed addressess? Did he file a change of address? What about the internet email update thing... wasn't that a clue that something was mailed out....?

This case sounds really complicated and even hard to give advice without better details... I know you said they can pay money... I think if they knew people in "places" it would be better than shelling out money on an interim attorney who has no details... Does his travelling attorney have any assisting attorney's?
 
He has been an illegal alien since 1992 until 2001 and then applied for asylum. I guess, the case has been in review/denial/court since then. How he found out about the letter? From what she told me - another attorney whom she consulted immediately after the guy was taken away told them that. I am puzzled myself how this all happened and how some random lawyer can find out something that their own lawyer did not know... They do not check case status online, their English is very basic and the the lawyer that handles their case is from the same country, so he the only one really capable of checking the case. I really do not know the details at all. Plus, I live in a different state and can only communicate with them by phone. All I want to do is to help them in some way and may be to point them to the attorney that can get this guy out of jail if that is at all possible. Is it possible or deportation is imminent?
 
My advice is whatever plan they come up with to try and save him. They have to be consistent with what his asylum claim is. And his story has been. I am not an attorney, but I do know that it is a challenging case they present... him being illegal from 1992- 2001 that is almost 10 years... how does one justify that?
 
Well, any time your case is in court, in any court , that court sends letter to attorney .
. I am being in immigration court for 17 years, always when my attorney get letter from court, he sends me copy of same letter , again , and make a phone call and asks me to come to his office so we can discus this matter if he is in vacation ,than hes colege ore who ever take cares of his bussnys dos the same..
It looks to me that relation client/attorney is not very clear here . you should ask them to be more honest with you, cause INS agent will not go in houses to pick up , unless he she have the criminal record..I being talking to INS agents and they told me that " we don't care unless he/she got criminal record"
Now for this kind of cases good attorney's charge betwin $10.000 and $13.000 .to take case .Since you are not in NY it will be I guess more.
I am waiting for letter to go on deportation hearing and it will cost me $10.000........Yes and you got to pay in advance .You guys that are waiting for GC got no Idea how lucky you are .

OMG Care2much 17 years? It is amazing how we sometimes forget what it is like to have a pending asylum case... i guess what is terrible about it comes from the fact that, if it is a denial you are immediately set for deportation. Which is an instant change to your life. And coming from the US, it is a shocking change...

I do agree with you, with regards to the communication aspect and details that he has. You cannot help someone without FULL details and documents to support the case.

As for the fees that is out of this world 10-13k... Yikes.. I wish you the best in your case, keep as posted

your friend boyfriend made a fatal mistake by depending completely on his lawyer, he threw all his trust on his lawyer, the lawyer is not his father or
his mother,

i was in a similar situstion, my case was denied by the the INS officer, by

the immigration judge, and then i decide to appeal, my lawyer advised me to drop the case, i refused, i decide to appeal , i paid my lawyer big sum of money,

i prepared all the facts regarding my asylum case, i gathered all the documents,

all my lawyer did is to mail my appeal to the court, after he filed tha appeal,

i was calling the court 1- 800 NUMBER to get the update about my case,

i won the appeal, i got the result before my lawyer know it, when i called my lawyer, he even did not remember me, and i found out that he lost my file in his office, i told him that the court will send him a written decision in a few days,

i mean, this example you cant trust any lawyer, you have to do everything by yourself,

But I guess, I had the advantage of knowing good English from the beginning. These guys have such basic English skills - in the range of hi and buy. For them it is out of question to be able to follow up anything by themselves or even call the 800 number. So all they had was that lawyer and it is possible that people like that get taken advantage of by lawyers who speak their language, as they know that the client has no other options.

Anyway, this guy DID not have any criminal problems. And it is possible that someone may be taken to the immigration jail, solely on immigration charges. I knew such people personally. And as far as I know they were released on the bail. It is a problem that I do not have their contact info anymore to ask about this. Plus, the laws change all the time. Please, someone advice something on this matter - is it possible to bail him out or is deportation unavoidable? I just can't handle his girlfriends tears anymore... And I am the only channel for her that can go on internet forum and communicate in English.

Sorry to hear about your friend. All I can tell you is that once they take you away, they deport you unless you have a really strong case. The fact that he was issued a deportation order means a lot and its bad news.

I would suggest you ask her GF to contact the senator as soon as possible and tell me the story of him being killed(if its valid) and hopefuly they can help you out.
 
I once tried to help a friend that was in jail by immigration violation charges...(he was in the US ilegaly, and had no criminal records)... and I tried to get him a bail... but the lawyer and the court explained to me that for immigration detentions once you are arrested and in jail, there is NO BAIL whatsoever.... My friend was deported withing 2 weeks...
 
Sorry to hear about your friend. All I can tell you is that once they take you away, they deport you unless you have a really strong case. The fact that he was issued a deportation order means a lot and its bad news.

I would suggest you ask her GF to contact the senator as soon as possible and tell me the story of him being killed(if its valid) and hopefuly they can help you out.
Thanks or your suggestion. I told them about contacting the Penn Congressman. They said that will try that today. She was also supposed to visit her BF in jail today, so I will know later how the situation is. They found an interpreter, so hopefully it will be easier for them to communicate now. Will keep you posted.

My friend was deported withing 2 weeks...
