Hi All,

Case History - I-140 AD - 5/22/02
Case recd by NVC - 6/14/02
Case Created - 6/19/02
Reconfi. letter sent - 6/28/02
P3 sent by NVC - 7/23/02
P3 Recd - 7/30/02
P3 sent to St. Louis - 7/31/02

Called today to check status and to my utter shock the AVM said "the case has been sent back to INS any further inquires should be directed at them ..........."

I have'nt been able to speak to operator as AVM just logs you out .. will keep trying..

My question is

1. Anybody thru this scenario
2. What are my options
3. Does anybody have INS number where they can be contacted..
4. Can you all pray for me..

Thanks
\rahul

contact your attorney, ASAP

plus, do nto give the case umber, give the INS receipt number while making phonecalls.. sometimes ppl have better success speaking to an operator that way, the ay the phone menu is structured.

Ask your attorney to call NVC and they might be able to tell them something or other. This is really a strange instance I have heard on this forum.

Rahul,
Try reaching INS 949 831 8427 (california...) This will be very busy and should keep trying.... Good luck.. Before that I suggest you to speak with NVC operator....

I spoke to NVC and came to know that INS (NSC) has requested the file back and It was mailed to NSC from NVC on 08/19/2002. Also checked with NVC and they hav't yet recd. my P3 from st. luios which I expect (going by dates on cptracker.com) they will receive by this weekend.

Called NSC and they are unwilling to give me (beneficiary) and info. but what they told me is that file has'nt reached back to them yet - I called my attorney and he is going to call them today. I am also going to ask my HR to call them. Will keep you all posted.

My question is - If the file has temporarily gone to INS ,when it comes back to NVC what will be its status ? Will my case still be open at NVC ?

Rahul,

There are several cases, with CP option in I 140 were initiated as AOS and later changed to CP. Check with them if this might have happened.. Hope things go better....

Same thing happened to me!

Rahul,

The same happened to me, my service center was/is NSC as well.

I filed for my i-824 on september 01 and it was approved on 3/02. However, the i-824 approval was sent back by NVC to NSC on 05/02.

No progress on it since. I did talk to NVC and I had my lawyer talk TO NSC several times but seems like nothing is being done. NVC says talk to INS and INS has "it will be done when it will be done" attitude.

The don't even give me a good reason why it was sent back.

This process has not been good to me.....

No concrete info. yet..

Called NVC and they have no info. why INS requested it back...

As the file has not yet reached INS they are unable to tell me why they requested it back.. its frustrating.. seems the reason why file went back is inside file...

Also - my P3 also reached NVC from St. Loius...

I am not sure whats happening .........or what to do .. except wait..

Yes.. it is frustarating without knowing what is happening with the case. Hope things go better.

Update

Bad luck continues and today NVC sent me back my P3 and a letter stating how I can get my fee back as my file has been sent to INS ....

Taked to NSC and they have'nt recd. the file. So I still have no idea why the file went back to NSC.

My lawyer has already sent a letter to NSC requesting them to send file back to NVC and askingfor reason as to why it was requested from NVC.

Guys,

Can I do AC-140 ? my 1-140 is approved for CP and my consulate in NWD.

Please do suggest any other options if there are any ...
