Upgrade from LPR to USC

Hi,

I hope someone will read my post and give me some goood advice and ideas.
First I must intorduce my situation. I am living in Atlanta. As a Green Card holder I am married with guy in Bosnia. After that visit I came back to US and fill forms for him (i-130...) last year. INS recive form and send me nottice.
After that I fill for naturalisation and yesterday (24/03) I get certificate of naturalisaion (i skip in this post interviews and other things).
What is my next step. Its very hard to live separate. I plan with my layer to upgrade petition from LPR to USC.

How long afther that we must wait to bee together in US?
How to aplly for K-visa....what form....I allready filled I-130. Can he come to US and to wait for preocess here together?
Anyone have expirience, tips...or knowlege about this it can be helpfull.

Hi mary, I have applied for my wifr january 99 while I was a gc holder. Now I became a us citizen. I ask Ins to change the application to wife of usc. According to ins customer service it might take upto 48 months just to approve the i130 application. This is ridiculous. I know if I apply her application in Bangladesh, it usually take 2-3 months to approve the application. Check with your lawyer and let me know if you have any update.

He is not eligible to apply for k-1. K-1 is for people who are NOT married yet. You will need to apply for a upgrade of petition to that of USC citizen. It is usually given at the naturalization ceremony. If not, you need to goto the local BCIS office and file it. He can also file for a K-3 visa(for spouses of USC while their case is adjucated.)
 
I'd file for a K-3 and then file a I-485 when he arrives. That will permit employment (File for EAD).

my case is similar to yours MARY ,i filed I 130 as a resident for my wife ,now that i became citizen (this week ),this is the steps i was explain to do
i will send my certificate to the BCIS in order to upgrade my case from resident to citizen ,as soon as i will get the receipt from the sevice center ,i will file I 129 F (which is by the way known as K3 VISA )to chicago ,the same file will be sent then to missouri then the state departement ,who will contact the embassy in which the marriage took place ,my wife will be called in for an interview .
the timeline for this process K3 is 9 to12 months .
i hope my inderstanding was correct ,
the K3 visa was introduced the help the spouses to come to the usa and then adjust their case instead of waiting for the I-130 to be approved (1-2 years ).

My wife is here in USA with V visa. Other day I called ins 800 number and they told me it take 48 -60 months for TSC to approve I-131. Ins got my wife's application on Jan99. We like to visit home but my plan has been posponed for this GC issue( She will have to get V visa again from home-- I don't want to take any risk). What should I do? Should I appy for K3 visa?

My situation is a bit similar to these. actually my wifes mother applied for my wife back in 1987 when she was a green card holder. subsequently we got married and at the time of interview my wife informed them. now my wifes mother is a US citizen and I was told that I can upgrade the same petition. wifes mother sent the I130 along with the papers for my wife to national visa center in Feb 2003.
can someone tell me if it was the right thing to do? and how long do they take to upgrade it.
