Update on Ngwanyia Vs Ashcroft

I decided to email one of the lawyers in the case and this is the response I got:

Dear Mr. XXXX,

We are still in negotiations in Ngwanyia v. Ashcroft. There was a continuance in the case so that these negotiations can continue. We will post an update on our website: www.ailf.org when there is an update to notify people about.

Well its frustrating to learn that negotiations are still going on. What is there to negotiate? Give the 25000 unused Green cards to the first 25000 in LIne and then from then on keep on giving 10,000 for the next year. BAm WAm thank u maam... So for the FY they should give 35,000 visas.. ARe they negotiating that the BCIS doesn't go to supreme court if the lawyer change the unused visas to 15,000?...Whats the deal? I wish the Judge was my father-in-law..damnit!!

Whats there to negotiate? Why the wait?? Its very weird..anybody a laywer..who can explain??

Do u think you can ask that same lawyer to give you an insight of the case.
I think he/or she should have access to that info. Give it a try :) :)

Actually I emailed her but I doubt she will tell me more...Maybe Law_Person can post the actual ruling that happened today...how long is the extension now..?

This confirms what I have said all along about this inefficient dept! What's there to negotiate? It all about their stupid ego my friend. The suckers do not like to be defeated! And we pay the price of their stubbornness.

I am really hoping that none of their "barking dogs" on this forum would jump to their defense and insult our feelings with garbage such "oh we are so grateful and happy that we were granted asylum, oh that's all what we need, we do not need a GC as long as we can see our families, oh...We should give the people at the INS a big kiss and a hug......man I am getting sick in the stomach....

Sorry, but I am mad as hell!

Take a look at the ruling, there are two parts of it . One is INS must adjust 22000 asylees that they failed to adjust over past years, and second the EAD card issue. And Judge added the comments called the Asylee treatment by the INS be a "national embarressment" which is my favorite part. I really have problem figuring out what they are "negotiating"? The number 22,000? should instead be 21900?.... .... .... ....
 
Punjabi_Munda, Can you please cut and paste that section. I wish i could read all of it but I don't have the time at work to do that.

For all other members..This is what Punjabi_munda was talking about from the lawsuit:

m) Order the defendants to properly record plaintiffs’ and class members’
adjustment dates to credit plaintiffs and class members for time they improperly spent waiting to adjust status, toward the five-year waiting period for naturalization.
 
Law_person has mentioned something about 3 years decrease.I presume that is much more than just 22000 adjusted asylees!

I wish it could be come true. But Judge Richard H. Kyle of the District Court of Minnesota ordered the federal government to adjust the status of the 22,000 waiting asylees and had not put any rulings related to m).

This is what i meant on the other thread when I said I read somewhere the lawsuit was trying to get us some of the years we spent waiting for adjustment. :) thanks for finding the text to support my claim - for a second there I thought I was hallucinating. :D In our world - it is often hard to keep facts separated from CIS fiction.

I hope the negotiations doesn't take this section out as it is crucial for all of us. Although I got my GC in 03, I might benefit from this if they say we can apply for citizenship sooner or something. Thats what I love about class action suits!
