Update on Ngwanyia V. Gonzalas (07-01-05)

This timetable did not change for months so it is NOT correct that it includes Ngwanyia V. Gonzalas outcome. So this is really weird since some 08/2000 people have been approved already...

But, it seems like CIS may not adjust those with ND 01 by this Fiscal year although they recently indicated (on their news release) that they requested RFI from those who have been identified for adjustment in the current fiscal year.

Those who applied in 2001 should receive GC's this year, those who applied in 2005 will receive green cards in 2016 (that's 11 years wait). I am applying next year so I guess I am gonna wait more than 11 years to get my GC???
What's going on? I thought DHS set the goal to be better and better every year in processing I-485 cases but it's just gettin' worse.

I don't believe that would be the case. The above processing timeline was established prior to the enanctment of the REAL ID which removes the 10,000/year cap. With the cap removed, you have better chance of getting your GC prior to 2010.
 
Then who can explain the following statement AILF made?

“Individual class members may determine the approximate date their adjustment of status may be granted by referring to the chart at http://uscis.gov/graphics/fieldoffices/nebraska/asyleeadj.htm

This chart does include the additional numbers of asylees the government is adjusting as the result of the settlement agreement. In other words, these numbers already have been factored into the chart.

I would have to disagree with you because on CIS website, right above the chart it says,"By law, only 10,000 asylees can adjust status to Lawful Permanent Resident per year; however..." So they did not factor in the settlement agreement and it was last updated on 3/18/05 before the settlement.
 
I agree with you, Mike. Your analysis makes sense.

Did AILF make a big mistake in its statement?
