Please see Mr.White's update below relative to the Hearing:

"Thank you to those who attended the hearing today. The hearing allowed for an airing and narrowing of the issues. We anticipate a decision before Friday. We will keep you posted."
 
UPDATE 13th July 2011: The judge decided there will be no in court hearing today and further testimony on the part of the DoS expert witness will take place in the form of written submission. As for the decision, it will be made before the 15th. It is not certain if today yet. It is highly probable that the decision will also be communicated in written. No further courtroom hearing is planned.
 
I am no lawyer. I am not a computer person. I have no insider knowledge, no contacts with DOS, KCC or Mr White. This is my opinion only.

If DOS loses the case and the 1st draw is reinstated then DOS are open to lawsuits from all those who were not selected.

If only the 22,000 get reinstated then DOS are open to lawsuits from those who did not check their results but may have been winners.

If DOS win - no one will sue again, it should be over.......BUT....... the government looks bad with the perception that official communication can be so easily disregarded. Trust in official communication is gone. The callousness with which DOS have handled the situation will remain an embarassment to the government.

The only way for DOS to really win and put it all to rest is to win the case (no more lawsuits from anyone) and then in a "goodwill" gesture, offer the opportunity to proceed to the 22,000 who can show they had been offically communicated with. (This makes them look good, sympathetic and diplomatic.) This solution also gives DOS the power to decide what to do about case numbers.

Any chance of this happening?
 
honnestly? look at how far DOS went... this won't happen, & also they can't suit for the non selected, who will they sue, themself?

Repetition!! Follow up ’ Result of the court hearing 12th July 2011’ thread.................all above issues av bin deliberated upon.........
