I know some one who filed I-140 & I-485 concurrently under substitution with priority date of November-2001 in EB-3 category in VERMONT service center. His I-140 has been approved and finger prints were done and results received by INS as per I-485 online message. His priority date is current. His received date of I-140 and I-485 is December-2004. When do you think his I-485 is going to approve. DO u know any one who got I-485 approved already with received date Dec-2004 in Vermont.

I'm in the situation you describe below. My I-140 was approved but they failed to retain the PD from my previous employer's I-140 (not revoked or withdrawn). The old PD makes me current but the PD on the new I-140 hits me with the EB3 retrogression.
The company lawyers now say the PD issue "has been taken care of" but don't give me any more info. I called VSC, and the rep didn't even seem to know what a PD was! She eventually said she can't see my PD anywhere on my case and I should not call again because this was an emergency number.

Is there a way to find out whether my I-485 is being processed as current or is pending due to retrogression? I don't want to file an FOIA because I've heard they take the file out of processing and it causes long delays.

The only approvals I have seen on the boards for vermont with receive date of december 2004/january 2005 was a couple of people who had 140 approved in the past and filed 485 only in december/january.

What is this number (the emergency number) you called ? I am also trying to confirm mine.
