Call to Action for a Defense of Family Amendment
Whereas, the first amendment to the Constitution of the United States
of America guarantees freedom of assembly,
Whereas, waiting in line for a lawful process and assembling with
family members should not be an either/or proposition,
Whereas, thousands of American citizens and lawful permanent residents
pay income tax on their spouses' foreign income at the same time that
their spouses are barred or otherwise prevented from entering the
country for years,
Whereas, there is no way for an American citizen or lawful permanent
resident to bring in a grandparent, grandchild, sibling, or fiancée to
visit,
We hereby call on all members of the Senate and the House of
Representatives to enact the following amendment to the Immigration
and Nationality Act:
Notwithstanding any other provision of law, the spouse, parent, or
child of a United States citizen or lawful permanent resident shall
not be barred or otherwise prevented from entering the United States
to live with and support said United States citizen or lawful
permanent resident.
Notwithstanding any other provision of law, the right of a United
States citizen or lawful permanent resident to live with his or her
spouse, parent, or child shall be taken into consideration in any
immigration process, and said United States citizen or lawful
permanent resident shall be entitled to appeal any decision infringing
on this right in a court of law.
Notwithstanding any other provision of law, the grandparent,
grandchild, sibling, or fiancée of a United States citizen or lawful
permanent resident shall not be barred or otherwise prevented from
entering the United States for the purpose of visiting said United
States citizen or lawful permanent resident.
