Unique Situation - pls respond

I am supposed to apply for 7th year extension in march, but I have
still not got my 45 day bec letter. Would my extension be in trouble
because of this not having got letter. My case is filed RIR ,went to
TX DOL on Mar 31st 2004.
Any responses appreciated.
 
You can apply for 7th year extension if your LC is pending for more than 365 days, Since your TX DOL date is 03/31/2004, I assume that the date your case was filed with a State Agency is before March 31st.

Start your count from the State SESA receipt date and if it is more than 365 days when you apply for 7th year extension, you should be fine..

45 day letter has nothing to do with 7th year extension. You just need the proof of your LC filing with the state..

Yes true, but what if the 45 day letter was not sent to me at all, or something went wrong with the delivery of the letter .... 3 others in my company already got the letter 2 weeks back.

I have the same situation. my 6th year h1 expiring beginning of march 2005. i have just started the paperwork for my 7th h1. my company is currently working on filing for it before feb. since i have not recieved the BEC letter either, my lawyer is going to send the philly dol receipt and initial receipt from the state to prove that my LC is still pending.

That will be nothing to do with your H1B extension. File the extension first and wait... just like all of us here waiting fo the letters.

7th year extension

my 6th year h1 will expire on FEB 31 2005. I had filed for for my 7th year extension based on the initial receipt from the state Chicago to prove that my LC is still pending.

hello FYI February has only 28 or 29 days!!!
