My situation:
1) I am on H1b visa and planning to visit India with my wife in December. I have to revalidate my H1B visa during India visit.
2) Currently my wife is on H4. Her H1b is approved (Change of Status H4 to H1) effective from 1st October 2006. She will have to stamp her H1b visa in India during visit in december.
Issue: As December appointments are not available I am planning to take Emergency appointment for my H1 restamping and my wife'S first H1 stamping through VFS website. For Emergency appointment VFS website quotes “H and L visa renewals for applicants who are already working in the U.S and are returning to their jobs."
Questions
1) As per guidelines I will be qualifying for Emergency appointment. As this will be my wife's first H1 stamp (h4 to h1) will she also qualify for emergency appointment with me?
2) It seems H1 applicant can add their spouse who are on H4 in same application on VFS. In my case can I add both of us (both H1 applicant) in same appointment through VFS website? So if I can get one Emergency slow it will work for both of us.
I have searched forum but I didn’t find this kind of case. Your help in this matter is greatly appreciated. Please let me know if you need any further information.
