Unique Situation I need help..

Hi,

I have a unique situation and I am not sure how to proceed. A little background.

My wife has dual citizenship(USA/Canada). She lived in the US for the first 12 years of her life. No income in the US.

Me I am Canadian, I have just been offered a Job in the US and they want me to get a TN visa. Is this possible where I am currently married to a US citizen? If so once I am in the US would it be possible for me to switch over to a green card? Or should I try for a green card before I leave for the new job?

Any help would be great.

Having a US citizen spouse could be problematic in getting GC. Even you admit that you are thinking of getting GC. This is known as immigrant intent and is a good basis for denial of entry on TN (or even as toursit).

If your spouse was staying in Canada while you went down for work, this would not be a problem. But if you all plan to move down for this job, you might get denied. Some have been able to pul it off, but this is uaully due to inattention of the admitting officer.

You could of course, as part of the move apply for GC first, but this would take some time before being able to work (at least 4 months).
