Hello

I worked for an Indian company in India and in US (on H1)... I got my GC via my wife...

After getting my GC - I requested the company to keep my in US which they did for a good period of time... But finally they said I need to go back to India as there was no work in USA...

I quit...

Can I claim for unemployment Insurance benefits ?

Please reply

Can I claim for unemployment Insurance benefits ?
Maybe, maybe not. You'll have to make the case that your resignation was effectively a forced termination, due to actions and decisions taken by the employer. If you had to move to India to keep a job with them, that is effectively an involuntary termination if you don't want to move to India. Nobody is expected to relocate out of the country to keep their job. Your claim would have been much easier if you simply kept the US job until they got rid of you.

Your problem is with getting documentary proof of it. Do you have something in writing saying the employer was terminating the position you held in the US and moving the job to India? Did the employer stop paying you? Were you on the US payroll?

You'll also have to meet whatever other requirements are in place according to state law, such as the length of employment, etc.
