Unemployment insurance help

hello,

i have a GC (got it in oct 2009), and was released from my company last june (6/10). I didnt realize i could file for unemployment insurance for around 4 months because I thought the govt dosent give unemployment benefits to people who are on permanent residency.

now i have filed for unemployment benefits and asked the govt to backdate the payments, but they have refused. My reason given for backdating was that my company did not tell me I could file for unemployment benefits. My request was denied because findings came back stating my employer had notices labeled everywhere which tells me my rights.

Maybe this was my negligence, or misinformation given to me... but i really want to appeal this stating that I didnt know or it was not clear to me that i could file for unemployment benefits as a permanent resident (i didnt state this explicitly in the original request).

Is this possible to ask govt for backdating because it was not clear on notice that permanent resident can also file? i really need help because this is a lot of money and i really need it..

i am in the same boat, i was a consultant working under contract. my pre-determined project ended, and I was out of the job after the completion of the project in due time. i was un aware that consultants who work on 1099 were eligible for unemployment benefits as normally the benefit is paid to those people who had full tlme jobs (those who work on w2 i suppose), where the employer is required to contribute towards paying benefits if workers get laid off. I did not file a claim, after a month, a friend of mine in the same shoes as I am (consultant+ project completed+ unemployed+ looking for a job) mentioned that he was on unemployment benefits. I called the department of labor for the state, filed a new claim, they asked me to start and continue to certify every week,as it might take time for them to approve the my claim, if at all the claim is approved I shall get what ever weeks i claimed for at one shot. After 2 months of department of labor sending me paper work and also the last recruiter i worked for, asking me to fax in my pay check stubs, the contract copy they approve my claim. I asked if I could have it back dated, they mentioned that I had to make a written request.So i did send them an email. I received a notice today saying that it cannot be back dated as I failed to register and certify weekly and no attempts were made from my end. I had requested a hearing. What do I have to lose anyways, besides a day's work.I am back and working but i sure could use that money.
 
They're not going to backdate your payments to a date before you first requested benefits. Sorry, that's just how the system works. In some states they will even reduce your benefits or deny it if you apply too late.
