Folks:

I have a green card from my employer, but do not have a job at this point. I want to get the citizenship, but also claim for my unemployment benefits. The law has been changed in 96 about public benefits claiming. Question is:

Can I claim unemployment benefits without future problems in my citizenship?

I appreciate your time to answer this.

what is considered as being public charge?

I just received my greencard. I dont know what is the meaning of public charge. JoeF says unemployment benifits are not public charge. can some body tellme what are considered as public charge.?

great article, and i still have a question...

where does it say that unemp benefits are not considered public charge? i do understand that being a public charge does not disqualify one\'s citizenship application. but still, it would be nice to avoid being labeled as a pub.charge and be able to claim unemp benefits, right?

(1) Only some receiving certain public benefits are public charges.

(2) Unemployment benefits are NOT even public benefits because
it is from insurance money whose premiums are
    paid by your employer.

Thanks for the long and helpful Q&A part. The question below confused me a little bit though. Benefits are insured, sure, and employers pay the premiums. But the State pays the benefit.

At another point in the Q&A, public charge is said to be a problem if you are asked to repay, but did not, etc etc. So I am not 100% that it is not weighted at all, but may be negligible.

Thank you very much again for your time and effort. I appreciate your input.

Q18: If an alien has received cash public benefits in the past, but has stopped, will INS or State find that he or she is likely to become a public charge?
A18: Past receipt of cash public benefits does not automatically make an alien inadmissible as likely to become a public charge. It is one factor that will be considered under the totality of the circumstances test to decide whether the alien is likely to become a public charge in the future. For example, if an alien received benefits in the past during a period of unemployment, but now has a job and is self-supporting, he or she would most likely not be found inadmissible as a public charge. The more time that has elapsed since the alien stopped receiving the benefit, the less weight it will be given. The length of time that an alien received benefits and the amount of benefits received are also relevant considerations.

By law, your employer has to pay, if they do not and one day
you find you are uneligible for UI, I believe you can
file a lawsuit (maybe a class action one) against them.
The government may also file criminal charges against
such employers if they intentionally choos enot to pay
the premium
