Guys, offer some tips here.
1. If someone quit the job instead of being fired, can he/she still claim unemployment benefit?
2. say someone is laid off can file for unemployment benefit, if he find an a part time internship, can he/she still claim unemployment benefit at the same time?
3. If someone directly graduate from school, but can not find a job, can he/she claim unemployment benefit?

Yes, you can claim, but it's unlikely you will be eligible for it. But in special circumstances, you can be eligible for it, if you can prove in EDD court that you were forced to leave due to certain condition/reason (like harassment, threat, health or your were misled by employer etc).

Depends on how much you earn from part-time job, compare to the salary from your last full-time job. If they are close, you won't get anything.


3. If someone directly graduate from school, but can not find a job, can he/she claim unemployment benefit?

NO.

Heh heh --- you get absolutely nothing with 485 pending @ CSC :D
 
Even for a citizen..., one has to be employed for the last 2 yrs... to ge un-employement benefit. So 3rd category is out of question....
A family friend after getting citizenship..., moved to India..., worked in India for 2 years..., resigned the job... moved back to US..., did not get a job for 1 year..., was not eligible for un-employement benefit too.
 
You need to work for 10 quarters before you can get unemployment benefits. You have proove that you were laid off. Quiting doesn't qualify, and you have to show that you are actively hunting for jobs. I don't think it is that cool to go on unemployment, people usually hate to be in the position where you have to take money. Besides if you abuse the system, you never know if it will be around when you really need it.
 
Answers to 1, 2 & 3 as posed, are No, No and No.
Unemployment benefit is not the same as being on welfare, though. Insurance premiums for this are paid for by employer. You may claim and receive UI benefits during AOS. They will ask for your A#. They also check with USCIS for eligibility. I dunno if the eligibility rules are different for people on H1-B versus people on EAD.
