My wife entered the U.S. with a K-1 Visa. For the K-1 Visa, she filed the appropriate forms including two affadavit of supports for two joint sponsors. As soon as she entered, we got married within a month.
My Current Dilemma: I filed i-485 to change her status to permanent residency and one of the requirements was to send affadavit of support forms. When I called USCIS twice, they told me both times that the affadavit of support forms did not have to be for the original joint sponsors which my wife used to come here on a k-1 visa.
Within a few weeks, I got a letter from USCIS stating the exact opposite: The affadavit of support MUST be filed for the ORIGINAL joint sponsors that my wife used for the k-1 visa.
As of now, my case is pending. I now have all documents for the affadavit of support for the original joint sponsors EXCEPT for the most recent tax return for just one of the joint sponsors. USCIS requires 3 of the most tax returns for each joint sponsor. Basically, I am missing only 1 out of three tax returns for ONLY ONE of the sponsors. I have ALL OTHER required tax returns, documents, etc. for the affadavit of support for both of them.
The actual problem: Why don't I have one tax return? The joint sponsor whose 1 tax return I do not have is a relative and very recently, they had some family problem with my parents who they won't speak to. Now they won't give me the tax return. It's very ridiculous and immature. But there is nothing I can do about it as I have already tried.
For my case, the 3 most recent tax returns are 2005, 2006, 2007. I don't have the relative's 2007-- I have 2005 and 2006. However, I do have the relative's 2004 but I did not use it because it isn't the 3 most recent (I had the 2004 because my wife made copies of everything when she filed her forms for the k-1 visa). Should I try filing with what I have? Should I try to change the joint sponsor? How?
I havent informed USCIS yet because I don't wan't my relative to be in any trouble. I'm not sure if a sponsor can get in trouble for something like this, so I'm staying on the safe side. I do not want to put my relative in any legal trouble, so no advice on how to sue or something like this.
