Unbelivable - Ridiculous! Should I call my Senator?

I spoke to a VSC IIO this morning about my case - EB1 with ND of 1/31/01. I expected her to say that my case had been assigned - but it turns out it could take at least another 90 days to even get assigned to someone. Her excuse was that they have a HUGE backlog. Geez! That\'s news to me!!! It must be the first time someone has said that!!!

Anyways, is it time to call my Senator? Some advice here will be appreciated.

Oops! I meant 1/31/00. I\'ve seen a ton of 1/31/00 approvals, and mine hasn\'t even been assigned as yet.

Most of the times IIO\'s won\'t give correct answer. So please wait for some more time. Your case will be approved soon

My case is very similar to yours, but one month earlier. My ND is 12/13/99 (EB1) and I haven\'t heard anything yet after the finger-print. My guess is that EB1 cases are reviewed by different officers and take more time to decide. Just look at recent approvals, they are mainly EB3\'s which are really straightforward decision to make.

Once my case is done, yours shouldn;t be long. Keep in touch and keep calm.

Your comment about contacting senator is very weird. Is the senator so readily available to you ? I hope you are not confused between senator and attorney. Even, attorneys are difficult to reach and you are talking about senator.

Its better to wait for another few weeks ( 4-6 ). Most of the time, IIO don\'t give the right info. Try calling INS again and recheck with someone else.

If you are single then according to my theory you better contact the senator. Otherwise just wait a couple of weeks and it will be there guaranteed!

YES, your senator is available to you for any undue delays in processing. Remember, you pay his/her salaries and he/she is your representative It\'s a service your senator\'s office offers - and they have their own lines into the INS.

In my case, I believe this delay is undue coz. not only is my case an EB1, but I\'m seeing SO many applicants with dates 2 months past mine get approved, and others in between saying that their applications are pending with officers. In my case, they haven\'t even assigned the case. That has really pissed me off.

Second, I AM married, so Mahasngram, your logic doesn\'t hold any water - and I have to admit I read your earlier postings, and they were quite silly. What reason would the INS have to approved married folks cases?

Finally, no, Eb1 cases for I-485 do not go to separate officers. They do go to separate officers for I-140, but after that, the paperwork for I-140s doesn\'t get looked at.

Anyways, earlier today, I did contact my senator\'s office. They will be getting back to me shortly.

Let\'s keep in touch. My case is one month earlier than yours, so I should do the same if it does make sense. I\'ll try to call VSC first to find out the status. BY the way, do you live in Massachussetts? Then we would have the same senitor. Let me know how they respond. You\'re right, we should ask for some service for the tax we paid.

By the way, how do you know that EB1/EB2 are all processed together? It does not appear to be the case to me though.

Shef, yes let\'s keep in touch because there just MIGHT be the chance that they\'re doing them (EB1 based) separately, however, unlikely it may be. The reason I know this coz. I have been in the green card application \'mode\' for about 4 years now and have had several discussions on this board and with several lawyers about this. Once you get into the I-485 queue, you simply wait your ND, as long as your PD is current. I started the process at one job, and then changed jobs when I got married, and so had to restart the process. I then co-founded a company, but managed to get a new I-140 done with the new company and also transferred my earlier application to the new company and so retained my PD. Each time I had a TON of paperwork to put together for the EB1 I-140 (huge pain), but this time round I actually started my process in July 1999 - so I\'m hoping to get the whole thing done in 2 years. Did you know that just 4-5 years ago, EB1 green cards took just 3-6 months?

Anyways, I\'m in NJ, not MA. So, I guess my senator is different from you. However, I do know that senators tend to be rather responsive to such cases. In fact recently, another colleague of mine had his GC held up for months with VSC refusing to give him a response. I advised him to call his senator, and he got his GC in 2 weeks.

Are you in NJ? Then why don\'t you contact Sen. Jon Corzine as well. This way, with more pressure from him office, VSC will get its act together.

But with the news out today that VSC is now officially tackling March 15th cases, my \'pissed off\' attitude hasn\'t improved. It\'s only aggravated.
