unbelievably confused!!!!

Hi all I am new to the forum and really need some advice.let me give you the background info on my situation first.
I met my husband in the middle of 1999 I knew instantly he was the one and only for me!! I was already fighting for custody of my oldest child and pregnant with #2.When my son was born we put my husbands name on the birth certificate. I fought for another 9 months for my kids got them moved home and almost released from state custody when I had an incident at work(customer attempted to rape me). So I lost my job due to inability to continue deliveries. The judge ordered me to find another job but I just couldn't. So they asked that I return my kids to the office. Instead I packed them up and took them to mexico (I was in a rather bad frame of thinking after the work incident). I brought my kids back to my home state trying to fix what I had messed up but the judge wouldn't even consider it.
Fast forward to 2006 my husband got a D.U.I. and did not do his court ordered class so PD picked him up on a warrant. He got turned over to ICE and they removed him back to mexico for 10 yrs in 2007. At that time I had been argueing with him and had went to stay with my aunt in another state. So when his brothers and my friends were looking for me of course they could not find me.
I need to know how do I start the procedure to bring my husband back home legally? I have been looking on uscis website and think I have an idea but not sure. Do I file I-130?
Also do I file the I-912 as without my husband here I am very broke and broken hearted?
Any input would be greatly appreciated!!
I did go to an immigration lawyer but again I am very poor without him here. One person did advise me to start fileing application and save my money for the attorney until I need to appeal if that need arises????
 
Are you a U.S. Citizen? You took your kids to Mexico. Are you Mexican?

If a USC or LPR, you can file an I-130 BUT it is probably premature to file now. If it does not get used quick enough it gets canceled. A waiver would be a longshot, at best.

As the I-130 filer you also MUST file an I-864 Affidavit of Support. You would probably need help from family or friends as joint sponsors to meet the income requirements. That's another problem.

If you just want to be together go to him in Mexico and worry about coming back later after he becomes eligible to file for a waiver.
