Unauthorized work and AOS interview

AOS interview

I am DV2005 winner. I have filed AOS 01/03/05, my number is current.

I am somewhat nervous about upcoming interview. In 2003 I was laid off from work due to company wide downsizing (I was on H1-B work visa). Two months later I switched my H1-B status to F1 status. I maintained my legal status at all times.

What do you think could happen?

One caution. The interviewing officer may be asking you this question for one of two reasons, either as general boilerplate or because he knows you were working illegally. If USCIS has evidence that you worked illegally and you lie, then you are faced with deportation and a statutory ban on ever re-entering the US.

I am not going to advise you to lie. What I will say is that you should consult an attorney for a $50-$100 consultation and ask what the consequences of admitting illegal employment are. If they're not fatal to the adjustment, then you should tell the truth.

If admitting illegal employment would be bad, then you should certainly not volunteer such information.
