UK Transit Visa

Dear Friends,

I apologize for posting a non I140 question on this board; I have been a long-time member on this board and I am hopeful that I can get some adise from the gurus.

My wife and I are going to India next week (through London, UK) and we both have valid VISAS for our re-entry to US in January. DO WE STILL NEED A UK TRANSIT VISA?

Transit visa is required only when you are coming back to United States on Advance parole and do not have any other kind of valid visa

I am planning to travel to India soon with AP. When I talked to my Lawyer, I was told that I would be fine when I travel with AP. BTW my H1 visa has been expired and my AOS is pending. My lawyer dint mention any thing about transit visa at UK. When AOS is pending, I am still having a valid visa right? Is UK transit visa required for me?

UK (or most European) transit Visa costs abt $50. I would consult the travel agent and the airline. If they suggest to get a transit Visa I would not risk it.

There have been instances in which travellers (usually US Visa holders) had been held up in UK and Germany. The worst thing that would happend is that your travel being delayed. There had been no report as whether they were sent back to their home country.

No. AP is not considered as visa. Hence you need transit visa if you are flying through some of these European Countries. You need transit visa while returning. If you are traveling through UK you need to get transit visa.

Attorney may not know about this, as transit visa is not related to US immigration. You can ask your travel agent. Do not worry. Getting transit visa is very simple.
 
I visited India and returned less than 3 weeks ago. I had the AP and did not obtain a transit visa. The person at the check-in was looking for proof that I would be allowed to enter the US. She did not know about the AP, she had to call her supervisor, and eventually accepted my AP.

I have noticed that everywhere (including India and my other stop along the way), airports/airlines were verifying the legality of my visit to US. I did not know about the need for a transit visa. I don't know if I got lucky this time, I would be very careful next time.
