Ugly practice of Chennai consulate

Hello gurus,

I want to know few details.I had a 221-g last year
happened in July.This was my first time H1-B
Stamping.Extra documents of employer in USA were asked
- like
1. Recent letter of offer from the US company
(original)2.Photographs (15) of the inside and outside

OF COMPANY 3.list of all clients and complete
description of all active projects 4.W-2 forms for all
people employed by the petitioner 5.Three years tax
returns
5. and many other details.....

There was no stamp on my passport (like Application
received ) but there is a 221g initial with date below
as 18/07 like
221g
18/07 with a ball pen.

I did not go for stamping again as the employer was
not efficient and not willing to provide all the
documents and also i have to go to chennai counsulate
.

NOW my biggest problem is, i am trying for Work
permit for UK/Canada or i may have to go thru my
company for a visa to Europe.In all those visa forms,
there is a question Q) Whether my visa was refused for
any country - NOW DO I HAVE TO SAY YES OR NO.Because
221-g is for incompletion of documents.I can in a way
go for USA Stamping even now.So would it be considered
as a Total refusal. Do you think if i keep NO i could
be in problems and say YES and reply to the UK or
Europe counsulate people,in case they particularly ask
about it.
Even for tourist visa of UK this question is there.

Please do reply back regarding this,as your experience
could help me a lot , when i actually have to file my
visa again.

Truth be told , your visa was refused. If I were you I will tell the truth. Write a letter why the company which was trying to hire you, backed out when US consulate demanded documentation.

Do you know who wrote that thing with the ball point pen ? I think you should complain to the consulate general. That is a unprofessional practice.

Thanks for the reply. But the ball point pen thing , i believe happens to everyone. Infact the chennai counsulate is so bad
when people are giving passports for 221-g for extra documentations they are keeping the passports for 3 months or more with out properly answering them. So i dont see any chance about complaining and stuff,if it could happen.
Like in my case my H1-B petition was approved in USA, BUT I DID NOT UNDERSTAND WHY THEY WERE validating the company's credentials in USA being in India rather than validating my credentials/certificates.

how can they keep a passport for 3 months

very alarming
I had my H1 rejected under 221(g) in 2002 but got approval after interview. Now again it has been rejected in 2004 under 221(g)
I am going on Feb 25.
In 2002 I had heard about they keeping passports but I thought that was a rumor.
In case they keep the passport - are there any precedent to one withdrawaing the H1 application altogether and asking for the passport back
 
Hello guys

I recently came thru the chennai consulate process.They do many things which may people wont expect them to do.They can reject in many ways and they dont have particular rules.

1. they may keep both your h1b and your passport
2.they might cancel your h1 and ask you to write a letter that you dont sue them .
3.They may refuse under 221 with out saying any reason.

so my advice for the guys gng to chennai is to take all the documents in its " may consider list" and for people who got for h1 extension try to take all your w2's,paystubs,company tax papers and some w2's of co-workers.

If you have all of those you are done in the chennai consulate.

This is indeed alarming.

Regarding The chance about complaining etc.

a. If you are in the US and they did mark something with a pen in your passport, complain to Dept of state.
b. If you are still stuck in chennai (or wherever) take a deep breath. You know the consulate is not going to approve any of your visas in the future. But you can start with complaining to the Consulate general. Consulate generals are not like your ordinary clerks who seek vengence on people who complain. You can also complain to the ministry of external affairs.

All of you can make a difference if you complain and be bold about it. You can also contact AILA (aila.org ) and send them a copy of the passport.


b. Why would somebody who gets a letter demanding to waive the right to sue them, write that letter in the first place? Do they do this by withholding your passport? Please dont make serious accusations without providing any proof. You should be able to demand your passport back, it is your document, not theirs.

Who is doing it? Did you all go through TTS when you got the passport back with those ballpoint markings?

I have already written to the consulate general. You should too.
