Hello Everyone, I Went To My Interview On The 16th Of May 2006, And The Officer Told Me That I Have Passed But A Decision Cannot Be Made At This Time Due To The Background Check Not Completed, But I Should Receive Oath Letter As Soon As Its Completed. But My Problem Is That In 2003 I Got A Misorderly Conduct And The Judge Told Me It Was A Violation And Not A Crime And Was Fined 62 Dollars Which I Paid, Can Anyone Tell Me If This Could Affect The Outcome Of My Background Check And Would This Stop Me From Getting My Citizenship Please Send Me Your Advices.

Can you post your time line, DO and Service center , also if you can give brief description of what was the original charge of disorderly conduct ?

Thanks

na,its a petty issue but no one can speculate if u will get ur citizenship...
but definitely your background check ,the fbi would have got a hit on your name, hence i am guessing its causing a delay in your name check.
but name check is not a issue here...
now was it misorderly conduct or disorderly conduct...(were you given a ticket for drinking in public or over a arguement with someone?)

btw plz confirm if it was misorderly or disorderly...

as far as i know misorderly is failing to pay fines...no issues at all wrt ur citizenship.
whereas disorderly is messing around ppl...tht stupid moral issue pops out...

If you weren't fingerprinted and arrested for the offense you didn't describe, then you don't even need to mention it on the application. FBI will not see them, as they won't be in state's database. If you did mention on N400, then they may take more time to get details.

Since you were arrested, you must have been fingerprinted. That would result in a hit in FBI process and would cause additional delays in clearing your case. Since the nature of the offense was reduced to misdeaminor, I think, you would not be denied of citizenship but would have to endure delays.

I have read long time ago some where in the USCIS website something related to " adjudication manual " and if I remember the clause for disorderly conduct was in chapter 73 for good moral character. Please google it and read. I am sure you will find what you are looking for. I don't know if it is updated and exists any more though.

Good luck.
