U.S. Citizen Marrying Indian Citizen -- need advice!

Hi,

I'm a U.S. citizen planning to marry my fiance, an Indian citizen here on a valid H1-B visa. Ultimately, he'd like to become a U.S. citizen. I'd welcome any advice about how to do this, including whether it's best to marry in the U.S. or in India. We want to have ceremonies in both countries, so all our relatives can be there, but would there be an advantage to marrying officially in the U.S. versus in India? I've been trying to find information on the internet, but it's very confusing.

In your case, it doesn't make a difference where you marry -- USCIS will recognize either*, and with an H1B visa, the marriage to you won't be an obstacle to reentering the US.

Then once you get married and he's back in the US, file for AOS and he should have a green card in a few months. Then 3 years after the green card he can be eligible to become a US citizen.


*provided you make sure to get the marriage certificate from India ... some couples who marry in India don't get the marriage certificate, which complicates things
