Hi,
I have noticed a typos in my last name in the I-129 application and I-797 (H1B approval notice) and also a typo in

My position instead of "Senior Programmer Analyst"
all the documents in the petition (LCA, cover letter, I-129) refer it as "Senior Program Analyst"

As I need to send these documents ASAP to my wife and son in India who need to get their H4 visas stamped, i asked the attorney to fix these issues with BCIS

but my attorney says these are minor mistakes which consulates doesnt bother and BCIS would not bother either as its a mistake in the title not in the job description..is that right..?

Do i really need an amendment to my H1 petiton..?

Please advice.

Thanks

---- if it is wrong in I-129 is mistake of lawyer and that is the reason I-797 or H1b approval has typo. It is NOT mistake of BCIS, your lawyer need to fix it and may be BCIS fees has to be paid again as it is lawyer mistake.

---- if it is Chennai India may be problems, ask your lawyer to attach a letter written to consulate and for POE inspector and if refused due to that typo lawyer should pay the fees to you that your wife and son will waste paying to consulate if visa rejected due to typo.
Do i really need an amendment to my H1 petiton..?
---- I will go for it

It is just a typo, not a deliberate one and it has no affect on your eligibility for a visa. GO by your attorney's advise.

Thanks for your advices ginnu and nkm-oct23,
I will verify with BCIS before making travel arrangements.

Meanwhile if it really requires a amendment /new petition, can i travel before fixing the issue with BCIS (use the documents as they are) while the petition is still pending.

Thanks
