Type of EAD application

Hi All,

I have a unique situation. I applied for my 485 applicaion in March 2002 and got 3rd EAD for myself. But the problem is with my wife's case. When we appllied for adjustment of status we also applied for EADs and got them. After that due to VSC error our AOS applications got rejected. My file has been reopened in time but my wife's file took time before they reopened. Mean while we applied for second EAD, I got mine approved because they reopened my case in time but my wife's EAD was rejected because her case was not reopened in time.

Now that her case is reopened I want to apply for her EAD and the problem is what option do I choose on the EAD application. Will it be renewal or a new application for EAD. When I spoke to my lawyer he told me that it should be new application. I no longer trust my lawyer because he is the one who dragged me into this mess with VSC.

I know it's a long message, your suggestions will be greatly appreciated.

Since the case is re-opened and you have the same 485 EAC numbers, the EAD application should be a renewal.
You have to also mention the last EAD validity dates in the application.
