12/25/2003: Agencies' Plan 2004: I-485 Backlog and Issuance of 2-Year Valid EAD (Series 4)

The BCIS has been considering for quite some time to issue a two-year valid EAD for the I-485 waiters in order to relieve itself from the increasing EAD processing workloads as affected by the growing delay of adjudication of I-485 applications. People must have noticed from the BCIS monthly report of immigration benefits petitions/applications that the EAD processing takes a substantial portion of its workloads which have kept growing because of the delays in processing of underlying I-485 applications. The BCIS may issue this proposed regulation soon with the 60-day comment period. This category will be reserved only for those applying for I-485 adjustment of status, or having filed Form I-485. The rule change would give the BCIS the flexibility to issue EADs for the length of time it anticipates that adjudication of a given case will take.
This is a very welcome move. However, one wonders where is the promise to reduce processing times of applications to six months.

This is not a welcome move but a ploy to keep
you hanging forever like mythical trishanku. You
would rather have your gc or keep getting 3 of these
2 year eads ? They are hoping that with these 2 year
eads they will keep your GC unadjudicated for so long
that you would either lose your job, or leave US for
some other reason. In either case Ashcroft and his
republican buddies including the Azzzhole racist director
of INS CA would be happy to have one less non european
immigrant to USA.

They are saying that 485 is being delayed because of EAD processings. Morons don't say that EADs are piling up because of delay in 485 processings. one year EAD should be more than enough. Having said that it is wise under the current circumstances to have a multi-year EAD.
 
Its a catch 22 .. EAD is delayed because of 485 and 485 is delayed because of repeated EADs ..

Why not issue 5 year Advanced Parole ..:o

Instead, how about the option of Temporary GC(Subject to final adjudication clause stamp)till finally decided?Akin to GC but not permanent in nature.
They can grant that Temp GC at final adjudication with Perm-stamp or revoke in case the application is not finally qualified .

it will relieve all EAD/AP etc. problems. and all major work load to CIS will be reduced and provides semi-security to applicant.

Yeah...they can top that with temporary citizenship....no wonder Hindu religion says nothing is permanent in this world...:D :D :D
 
The problem with temp GC is that once issued it is difficult to trace them back in case INS want to revoke them. What is going to happen is that scam artist will come and file bogus 485 to get these ltemp GCs. .. there are other issues related to welfare programs. ..

I guess there is no good alternative to processing 485 in reasonable time frame.

Do you know when will this come into law!!!

I need to apply for my EAD next month, if this comes soon I will do it later!!!!
